Terms of use

These Terms govern the use of FotoMemoris by hosts, buyers, guests and visitors. By creating an account, joining an event, accepting the legal documents, uploading media or purchasing an event, you state that you have read, understood and agree to these Terms and the Privacy Policy.

If you use FotoMemoris on behalf of a company, school, organizer, venue or other entity, you state that you are authorized to bind that entity to these Terms.

If you do not agree with these Terms, do not use the platform.

FotoMemoris lets hosts create digital events where guests use a link or QR Code to capture or upload media, such as photos, boomerangs and short videos, creating a collaborative album with privacy, reveal, capacity and retention rules defined by the host.

The platform is a digital service for organizing, capturing, temporary storage, display and controlled sharing of event memories. It does not replace a professional photographer, event planner, permanent backup, image-rights legal service or privacy consulting.

• You must provide true, complete and up-to-date information.
• The account must be used by a real person or legitimately represented entity. Automated, false or abusive accounts may be blocked.
• Login may happen by phone/SMS or another available method.
• You are responsible for maintaining control over your phone, session, device and access.
• Minors must use the platform with authorization and supervision from legal guardians.

The host is responsible for the event they create and the configuration choices made in the product.

• Inform guests about the use of FotoMemoris and the collection, display and retention of media.
• Obtain necessary authorizations from participants, legal guardians, suppliers, artists, brands, venues or third parties depicted.
• Choose the appropriate privacy mode: host only, authorized guests or access by shareable link.
• Control who receives the QR Code or invitation link and understand that forwarded links can expand the audience.
• Download media they want to preserve before the retention period ends.
• Not create events for illegal, discriminatory, violent, pornographic, fraudulent, invasive purposes or purposes that violate third-party rights.

• Upload only media you own or are authorized to upload.
• Respect privacy, image rights, honor, intimacy, copyrights, trademarks and event rules.
• Do not upload illegal, abusive, sexually explicit, discriminatory, threatening, violent, defamatory content, content exposing sensitive data improperly or content that puts someone at risk.
• Do not bypass upload limits, capacity, authentication, SMS, reveal rules, payment or security.
• Do not copy, download, republish or use other people's media outside the context authorized by the host and the law.

You keep the rights you have over photos, videos, boomerangs, names, cover images and other content sent to FotoMemoris. LYKOS does not buy or take ownership of that content.

By uploading content, you grant LYKOS a limited, non-exclusive, worldwide, royalty-free license for the time needed to host, process, technically reproduce, resize, display, transmit, make available, download, remove and operate the content inside FotoMemoris, according to event settings and these Terms.

This license exists so the service can work. It does not authorize LYKOS to sell your photos, use your image in advertising, publish your album as a commercial case or train AI models with private content without specific authorization.

You state that you have sufficient rights and authorizations to upload the content and that the upload does not violate third-party rights.

FotoMemoris offers privacy modes and reveal rules. Depending on the configuration, media may be visible only to the host, to participating guests or to people with a shared link.

Even in private events, the platform cannot prevent authorized people from downloading, taking screenshots, recording the screen or forwarding the link outside FotoMemoris. Hosts should choose settings with that risk in mind.

FotoMemoris does not manually review all media before publication or reveal. We may remove, block, restrict, preserve or report content when there is indication of violation of these Terms, abuse, security risk, legal violation, authority order or legitimate data subject request.

We may also suspend guests, hosts, events or accounts involved in fraud, spam, harassment, privacy violation, attempted intrusion, abusive chargeback, unauthorized commercial use or operational risk.

• Drafts may depend on payment, code, credit or unlocking to become active.
• Events have start, end, reveal mode and retention period configured in the product.
• After the retention period, media may be permanently deleted.
• Cancelled, deleted or expired events may stop allowing entry, upload, reveal, download or viewing.
• The host is responsible for downloading the album before expiration if they want a permanent copy.

We may keep minimum records after deletion or expiration when needed for payment, support, audit, security, legal obligations or defense of rights.

Plans, capacities, credits, bundles, retention extensions and other paid items are shown at checkout. Prices may vary by offer, capacity, campaign, seller, coupon, taxes, installments or gateway conditions.

Payments are processed by Mercado Pago. Approval may be immediate or take time, especially for pending Pix, card review, anti-fraud checks, communication failures or gateway instability. A paid event should only be considered unlocked when approved status is confirmed by the gateway and reflected in FotoMemoris.

FotoMemoris may allow resuming pending Pix, canceling pending Pix, switching to card, retrying after failure, syncing status or releasing credit/inventory according to product rules. Pending, rejected, cancelled or expired charges do not guarantee permanent access to the paid event.

For online purchases made by consumers, we respect the applicable right of withdrawal under the Brazilian Consumer Defense Code. When applicable, the request must be made within the legal 7-day period.

Because this is a digital service tied to an event, refund analysis considers the stage of service execution. After the event starts, guests join, uploads/downloads occur, storage/retention is materially consumed, code/credit is used or the service is substantially executed, commercial refunds may be denied, except when the law requires a different solution or when there is a failure attributable to FotoMemoris.

Cancellations before use may generate refund, charge cancellation or return of credit to inventory, depending on payment method, gateway status, purchase type and commercial rules shown in the product.

Fees, deadlines and refund method may depend on Mercado Pago, card issuer, bank, Pix, anti-fraud or applicable tax rules.

We may request tax ID, address, email and other billing data to process payment, issue receipts, issue invoices when applicable, comply with tax obligations and provide financial support.

You are responsible for providing correct tax data. Errors may prevent issuance, correction or reissuance within legal deadlines.

We make reasonable efforts to keep FotoMemoris available, secure and fast, but the service may suffer downtime, maintenance, browser/device limitations, internet failures, provider instability, payment delays, camera restrictions or storage problems.

We may modify, add or remove features to improve the product, security, performance, business model or legal compliance, preserving acquired rights when applicable.

FotoMemoris depends on third parties such as Firebase/Google Cloud, Mercado Pago, ViaCEP, SMS providers and hosting, security and support tools. Use of those services may be subject to their own terms, policies, deadlines and limitations.

We are not responsible for failures caused exclusively by third parties outside our reasonable control, but we will make efforts to diagnose, communicate and reduce impact when this affects FotoMemoris.

• Violate law, court order, image rights, privacy, intellectual property, trademark, honor or third-party security.
• Send malware, spam, phishing, misleading, automated, fraudulent content or content attempting to exploit vulnerabilities.
• Scrape data, reverse engineer, bypass authentication, access accounts/events without authorization or test security without permission.
• Use the platform for pornography, sexual exploitation, child abuse, hate speech, threats, harassment or non-consensual intimate exposure.
• Resell, sublicense or commercially exploit FotoMemoris without authorization.
• Create abusive chargebacks, simulate payments or defraud offers, credits, sellers, coupons or inventory.

FotoMemoris, LYKOS, trademarks, logos, visual identity, interface, texts, product organization, code, databases, flows, design elements and own materials belong to LYKOS or its licensors.

You receive only a limited, revocable, non-exclusive and non-transferable license to use the platform according to these Terms.

To the maximum extent permitted by law, FotoMemoris is not liable for content uploaded by users, loss caused by inadequate host configuration, third-party link sharing, downloads/screenshots made by authorized people, failures in the user's internet/device, lack of guest participation or artistic quality of media.

Nothing in these Terms excludes mandatory consumer rights, liability for willful misconduct, gross negligence, legal violations that cannot be limited or guarantees that the law does not allow to be waived.

Where limitation is permitted, LYKOS total liability related to the service is limited to the amount paid for the item that originated the claim in the 12 months before the event giving rise to liability.

We may suspend or terminate access, event, account, upload, link or payment when there is violation of these Terms, security risk, fraud, non-payment, chargeback, authority order, legitimate data subject request or relevant operational need.

When possible and safe, we will try to communicate the reason and allow correction. In serious, urgent or illegal situations, the measure may be immediate.

We may update these Terms to reflect changes in the product, laws, providers or business model. The current version will be available on this page.

Material changes may be communicated by notice in the product, email, SMS or another appropriate channel. Continued use after the new version becomes effective indicates agreement, except when the law requires specific acceptance.

These Terms are governed by Brazilian law.

In consumer relationships, the venue legally granted to consumers is preserved in the applicable cases, including the consumer's domicile for supplier liability claims when provided by the Brazilian Consumer Defense Code. In business or non-consumer relationships, the venue of Belo Horizonte/MG, Brazil is elected, unless a mandatory legal rule provides otherwise.
